Neighborhood Notice: Leash Laws, Service Dogs & Pet Cleanup
Situation Recap: Complaints have been filed with the Board regarding dogs running away from owners and not responding to commands, or owners allowing dogs to run loose.
South Carolina State Law
Under SC Code §47-3-10, a dog is considered to be “running at large” if it is off its owner’s property and not physically restrained by a leash or similar device. Owners can be fined if dogs are found at large.
Lancaster County Ordinances
- Pets must be under restraint at all times when off the owner’s property.
- Pets may not be on another person’s property without permission unless leashed.
- Invisible fences are allowed only if clearly marked with signs.
- Tethering is restricted; if used, chains must be at least 10 feet, and pets must have shelter, shade, and water.
Service Dog Clarification
Service dogs are protected under federal ADA law and South Carolina statutes. However, they are not automatically exempt from leash laws. Service dogs must remain under control—by leash, harness, or voice command—unless the handler’s disability prevents the use of a leash. False claims of a service dog are a criminal offense in South Carolina.

- Clean up after their pets in common areas, sidewalks, and grassy areas.
- Do not allow pets to run free, defecate, or urinate in shared spaces.
- Be courteous and respectful when neighbors raise concerns.
Enforcement & Reporting
The HOA does not have legal authority to enforce leash laws. Enforcement is handled by Lancaster County Animal Control and the Sheriff’s Office.
